1. Service Description

Welcome to Lumina AI (the “Service”). This Service is an AI-powered image generation platform that allows users to upload photos and generate AI-stylized portraits. By using this Service, you agree to comply with the following terms.

2. Eligibility

You must be at least 18 years old or have reached the age of majority in your jurisdiction to use this Service. Minors must use this Service under parental supervision.

3. Account & Credits

• You must register an account to access full features
• Credits are virtual consumables and are non-refundable once purchased
• Credits are for personal use only and may not be transferred or sold
• We reserve the right to freeze or terminate accounts for violations

4. User Content

You are responsible for all content you upload. The following content is prohibited:

• Content that infringes on others' portrait rights, privacy, or intellectual property
• Pornographic, obscene, violent, or illegal content
• Unauthorized use of others' photos
• Content that may be used for fraud, impersonation, or other illegal purposes

4.1 Acceptable Use Policy (AUP)

Our platform is committed to providing a safe, professional AI portrait generation service. The following activities are strictly prohibited:

• Uploading or generating any NSFW (Not Safe For Work) content, including but not limited to nudity, semi-nudity, pornographic, or sexually explicit material
• Uploading or generating any sexually suggestive content, including but not limited to undressing, provocative poses, or excessively revealing attire
• Creating deepfake content, or any material intended to mislead, impersonate, or defame others
• Generating content involving violence, hate speech, terrorism, or harassment
• Attempting to circumvent content safety filters in any way

Violations of this policy will result in immediate content removal, forfeiture of credits, and account penalties under our progressive ban policy (see Section 10). We employ automated content moderation systems to scan both uploaded images and AI-generated outputs to enforce this policy.

5. Intellectual Property

You retain all rights to your original uploaded photos. For AI-generated content, you receive a non-exclusive personal use license. You grant us a limited license to display and process your uploaded content solely for providing the Service.

6. Service Limitations

• We do not guarantee the accuracy or satisfaction of AI-generated results
• Service may be temporarily interrupted for maintenance or technical reasons
• We reserve the right to modify or terminate the Service at any time

7. Disclaimer

This Service is provided “as is” without any express or implied warranties. To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, or consequential damages resulting from use of this Service.

8. Changes to Terms

We may update these terms from time to time. Significant changes will be notified via website announcement or email. Continued use of the Service constitutes acceptance of the updated terms.

9. Image Storage & Data Retention

To optimize storage costs and ensure sustainable service operation, we implement the following image storage policies:

• Your uploaded original photos (reference images) will be automatically deleted 30 days after generation. You may also delete them manually at any time.
• AI-generated portrait images will be automatically compressed to WebP format 30 days after generation to optimize storage.
• Compressed images may have slightly reduced quality but remain fully viewable and downloadable.
• We recommend downloading your original HD images within 30 days for the best quality experience.
• You can delete any of your works at any time.

10. Content Moderation & Account Suspension

To maintain a healthy platform and regulatory compliance, we implement automated content moderation:

• Uploaded images are automatically screened for prohibited content including pornography, violence, and terrorism
• Rejected content will be blocked immediately and no credits will be deducted
• Violations trigger progressive action: 1st–2nd offense — warning only, 3rd — 1-day ban, 4th — 3-day ban, 5th — 7-day ban, 6th+ — permanent ban
• Suspended accounts cannot access image generation services during the ban period
• We reserve the right to make final decisions on content violations and enforcement actions
